Creditors' Rights

Daniel G. Kielczewski leads Abbott Nicholson, P.C.’s Creditors’ Rights Practice. Our primary focus is the representation of secured and unsecured creditors. We also provide counsel to troubled borrowers and other debtors. Our services include loan workouts, asset recovery, and debt collection.

We regularly prosecute and defend claim and delivery matters, garnishments, receiverships, and statutory and common law liens in connection with all types of commercial and consumer transactions. We are experienced in representing our clients in a wide variety of bankruptcy court matters including seeking relief from the automatic stay provisions of the Bankruptcy Code, adequate protection of cash collateral and other lien rights, setoffs, and other relief against individual and corporate debtors.

We represent companies large and small on a wide range of complex bankruptcy matters, including the prosecution and defense of adversary proceedings concerning allegations of fraudulent conveyances and preferential transfers. Our experience includes the representation of banks, leasing companies, and other lenders in a wide array of real and personal property based secured loans, as well as in equipment lease financing arrangements.
