THE NATIONAL LABOR RELATIONS BOARD'S

NEW POSTING REQUIREMENT FOR EMPLOYERS

 
   
 

    The National Labor Relations Board (NLRB) issued, on August 30, 2011, its Final Rule which requires private sector employers to post notices of employee rights under the National Labor Relations Act (NLRA) in the workplace.  This notice states, among other things, that employees have the right to join and form unions.  It also gives examples of prohibited employer conduct (as well as conduct prohibited by a union).

 

     Prior to the adoption of the Final Rule, the NLRB received about 7,000 comments regarding the then proposed rule.  The NLRB did make a few modifications following its receipt of these comments.  For example, employers do not have to distribute the new notices to employees in an electronic format.  Employers also may post the notices in either color or black and white.
