LABOR AND EMPLOYMENT LAW UPDATE  

THE NLRB EXTENDS IMPLEMENTATION OF THE POSTING NOTICE 

 
   
 

       As we previously advised you in an Update, on August 31, 2011 the National Labor Relations Board (NLRB) issued a Final Rule, which requires private sector employers to post notices advising employees of their rights under federal law that among other things, they have the right to join unions and participate in concerted activities.  The NLRB set November 14, 2011 as the implementation date for this posting requirement.

 

        On October 6, 2011, the NLRB extended the deadline for the Notice posting to January 31, 2012.  It said that the extra time would allow employers to "enhance" their education in this area of the law.  No changes were made to the content of the notice.  Copies of the notices are available without charge from the NLRB's website.  Interestingly, there are several, federal lawsuits currently pending which challenge the posting requirement.  Hopefully, some of these may be resolved favorably for employers before the new posting date.
